Termini di Servizio ed EULA Addendum di Flufiny

Questi Termini regolano l'uso dell'app Flufiny. Per le app distribuite tramite App Store, si applica anche la Licenza standard Apple per applicazioni concesse in licenza. Questo documento integra tale licenza con condizioni specifiche per Flufiny.

2. Licenza d'uso

Flufiny e' concessa in licenza, non venduta. L'utente riceve una licenza personale, revocabile, non esclusiva e non trasferibile per usare l'app sui dispositivi compatibili associati al proprio account Apple, nel rispetto della Licenza standard Apple e di questi Termini.

3. Funzioni

Flufiny consente di gestire bilanci personali, familiari e dati utili a stimare riserve fiscali per Partita IVA. Le funzioni possono includere conti, movimenti, categorie, periodici fissi e variabili, proiezioni, report, OCR on-device, export, sync cifrata iCloud Drive e funzioni premium.

4. Nessuna attivita' regolamentata, nessuna consulenza

Flufiny non e' una banca, un istituto di pagamento, un istituto di moneta elettronica, un broker, un intermediario finanziario, un consulente finanziario abilitato, un commercialista, un caf, ne' un fornitore di servizi di pagamento, di iniziazione pagamenti o di aggregazione conti ai sensi della direttiva PSD2 (UE 2015/2366). Flufiny non effettua, non riceve e non intermedia pagamenti, non gestisce conti correnti, non concede credito e non fornisce raccomandazioni di investimento personalizzate.

Flufiny e' uno strumento di organizzazione personale e non sostituisce un commercialista, consulente fiscale, consulente finanziario o altro professionista. Proiezioni, calcoli fiscali, stime e report sono indicativi e dipendono dai dati inseriti dall'utente.

5. Dati, backup e frase di recupero

Flufiny e' local-first. Se l'utente attiva la sincronizzazione cifrata, deve conservare con cura la frase di recupero: Flufiny non puo' recuperare un vault cifrato se tale frase viene persa.

6. Sync cloud opzionale

La sincronizzazione usa servizi terzi scelti dall'utente, come iCloud Drive, soggetto ai rispettivi termini. Flufiny cifra i dati prima del caricamento ma non puo' garantire la disponibilita' continua di servizi terzi.

7. Acquisti in-app e abbonamenti

Le funzioni premium possono essere offerte tramite acquisti in-app o abbonamenti gestiti da Apple. Prezzi, rinnovi, cancellazioni, rimborsi e metodi di pagamento sono gestiti tramite App Store e account Apple.

8. Uso consentito

L'utente si impegna a non usare Flufiny per scopi illeciti, aggirare abbonamenti o sicurezza, decompilare o distribuire l'app oltre quanto consentito dalla legge, interferire con i servizi o violare diritti di terzi.

9. Garanzie e responsabilita'

Nei limiti consentiti dalla legge, Flufiny e' fornita "cosi' com'e'" e "come disponibile". Non viene garantito che l'app sia priva di errori o che i calcoli siano sempre corretti o aggiornati.

Nei limiti consentiti dalla legge, il fornitore non risponde di danni indiretti, perdita di dati, perdita di profitti, errori fiscali, decisioni economiche assunte sulla base dell'app, indisponibilita' di servizi terzi o perdita della frase di recupero. Restano fermi i diritti inderogabili dei consumatori.

10. Privacy, legge applicabile e contatti

Il trattamento dei dati e' descritto nella Privacy Policy su flufiny.it/privacy. Questi Termini sono regolati dalla legge italiana, salvo norme inderogabili di protezione del consumatore. Contatto: support@flufiny.it.

Flufiny Terms of Service and EULA Addendum

These Terms govern the use of the Flufiny app. For apps distributed through the App Store, Apple's Standard Licensed Application End User License Agreement also applies. This document supplements that license with terms specific to Flufiny.

1. Provider

2. License

Flufiny is licensed, not sold. The user receives a personal, revocable, non-exclusive and non-transferable license to use the app on compatible devices associated with their Apple account, in accordance with Apple's standard EULA and these Terms.

3. Features

Flufiny helps manage personal, household and freelance budget data. Features may include accounts, transactions, categories, budgets, recurring rules, projections, reports, on-device OCR, export, encrypted iCloud Drive sync and premium features.

4. Not a regulated financial activity, no advice

Flufiny is not a bank, payment institution, electronic money institution, broker, financial intermediary, licensed financial advisor, accountant or tax preparation service, nor a payment service provider, payment initiation service provider or account information service provider within the meaning of the PSD2 directive (EU 2015/2366). Flufiny does not execute, receive or intermediate payments, does not manage current accounts, does not grant credit and does not provide personalized investment recommendations.

Flufiny is a personal organization tool and does not replace an accountant, tax advisor, financial advisor or any other qualified professional. Projections, tax calculations, estimates and reports are indicative and depend on data entered by the user.

5. Data, backups and recovery phrase

Flufiny is local-first. If the user enables encrypted sync, the user must keep the recovery phrase safe: Flufiny cannot recover an encrypted vault if that phrase is lost.

6. Optional cloud sync

Sync uses third-party services chosen by the user, such as iCloud Drive, subject to its respective terms. Flufiny encrypts data before upload but cannot guarantee the continuous availability of third-party services.

7. In-app purchases and subscriptions

Premium features may be offered through in-app purchases or subscriptions handled by Apple. Prices, renewals, cancellations, refunds and payment methods are managed through the App Store and the user's Apple account.

8. Acceptable use

The user agrees not to use Flufiny for unlawful purposes, bypass subscriptions or security, decompile or distribute the app beyond what law allows, interfere with services, or violate third-party rights.

9. Warranties and liability

To the extent permitted by law, Flufiny is provided "as is" and "as available". No guarantee is given that the app will be error-free or that calculations will always be accurate or up to date.

To the extent permitted by law, the provider is not liable for indirect damages, data loss, loss of profits, tax errors, economic decisions made based on the app, unavailability of third-party services or loss of the recovery phrase. Mandatory consumer rights remain unaffected.
